Rule 116
Auction sale of goods and collection of money

(1) In accordance with sub-rule (4) of rule 115, if the supplier does not immediately withdraw the rejected goods, the public body shall give written information to the supplier to pick up such goods and take them back within the time period specified in the purchase agreement and to supply the goods as per the specification instead.
(2) If the public body sends the information as per sub-rule (1) by post or courier service, it shall send a letter with a return receipt.
(3) If the supplier refuses to take delivery of the goods within the notice period as per sub-rule (1) or if the goods are not picked up within the time period specified in the purchase agreement, the related public body shall sell the goods at public auction and store the goods and other related expenses, the remaining delivery amount, predetermined Compensation and any other amount that he has to pay to the public body, including that amount, shall be deducted from the auction sale price and the remaining amount shall be returned to the supplier.
(4) The uncollected amount including the amount received from the auction sale as per sub-rule (3) shall be recovered from the supplier in accordance with the prevailing law as government dues.
